Terms of Service

These Terms of Service ("Terms") govern your use of the Naviware website and the products published by Naviware Research & Development LTD ("Naviware," "we," "us," or "our"), including our browser extensions, VS Code extensions, developer packages, and platforms (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Services. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Our Products
Naviware publishes several distinct products, each with its own purpose and, in some cases, its own additional terms:
- Browser and VS Code extensions distributed through the Chrome Web Store and Visual Studio Marketplace are also subject to the terms of those respective platforms.
- Our open-source packages (such as Tidings and Baseline Lens CLI) are distributed under the MIT License, as stated in each package's repository. Nothing in these Terms restricts your rights under that license.
- Platforms still in development (Nyansapo, Chopwell, Onuado, Badwenba) are not yet available for general use. Joining a waitlist does not create any obligation on our part to deliver the product by any particular date, or at all.
3. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' data
- Reverse engineer any part of the Services beyond what is permitted by an applicable open-source license
- Use the Services to generate content that is illegal, infringing, or harmful to others
4. AI-Powered Features
Several of our products (including Delight, Reprompt, and Change Scribe) integrate third-party AI models to generate content. AI-generated output may be inaccurate, incomplete, or inappropriate for your purposes. You are responsible for reviewing and verifying any AI-generated content before relying on it, and Naviware is not responsible for decisions made based on AI-generated output.
5. Intellectual Property
The Naviware name, logo, and website content are owned by Naviware Research & Development LTD. Our open-source products are licensed under the terms stated in their respective repositories (typically MIT), which take precedence over these Terms for matters of code use and redistribution.
6. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Naviware Research & Development LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including damages resulting from AI-generated content, data loss, or service interruption.
8. Termination
We may suspend or discontinue any part of the Services at any time. You may stop using the Services at any time by uninstalling the relevant extension, discontinuing use of the relevant package, or ceasing to access the website.
9. Governing Law
These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after a change constitutes acceptance of the updated Terms.
